How do we collect your data?
Your data is collected when you provide it to us. This may include, for example, data that you enter in a contact form or submit when registering for a newsletter.
Other data is collected automatically or with your consent when you visit the website by our IT systems. This is primarily technical data (e.g. internet browser, operating system or time of page view) as well as data on your usage behaviour.
2. Hosting
We host our website with our service provider:
Plutex GmbH
Hermann-Ritter-Str. 110
28197 Bremen
(hereinafter referred to as ‘Plutex’)
When you visit our website, Plutex collects various log files, including your IP addresses.
For details on data processing, please refer to Plutex’s privacy policy: https://www.plutex.de/datenschutz.
Order processing
We have concluded an order processing agreement (AVV) with the above-mentioned provider. This is a contract required by data protection law, which ensures that the provider only processes the personal data of our website visitors in accordance with our instructions and in compliance with the GDPR.
3. Consent and cookie management
Consentmanager
Our website uses consent technology from consentmanager.net to obtain your consent to store certain cookies on your device or to use certain technologies and to document this in accordance with data protection regulations. This technology is provided by Consentmanager AB, Håltegelvägen 1b, 72348 Västerås, Sweden (hereinafter referred to as “Consentmanager”).
When you visit our website, a connection is established to the Consentmanager servers in order to obtain your consent and other declarations regarding the use of cookies. Consentmanager then stores a cookie in your browser in order to be able to assign the consents you have given or their revocation to you. The data collected in this way is stored until you request us to delete it, delete the Consentmanager cookie yourself, or the purpose for data storage no longer applies. Mandatory legal retention obligations remain unaffected.
Consentmanager is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6 (1) (c) GDPR.
4. Analysis and advertising
Matomo (Cookieless)
We use the open source software Matomo on this website to analyze the surfing behavior of our users. We have configured Matomo so that no cookies are stored on your device. The analysis is carried out using so-called fingerprinting, which changes with each page view and does not allow permanent identification.
Your IP address is immediately anonymized during processing (e.g., by truncating the last digits) so that you remain anonymous to us as a user. The data collected by Matomo is stored on our own servers (or at our host Plutex in Germany) and is not passed on to third parties.
The use of this analysis tool is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the anonymous analysis of user behavior in order to optimize both its website and its advertising. Since no cookies are set and the IP address is anonymized, no consent is required for this form of reach measurement.
If you still do not agree to the storage and use of your data, you can deactivate the storage and use here:
Google Analytics 4 (GA4)
If you have given your consent, Google Analytics 4, a web analytics service provided by Google LLC, is also used on this website. The responsible body for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).
Nature and purpose of processing
Google Analytics uses cookies that enable an analysis of your use of our websites. The information collected by the cookies is usually transferred to a Google server in the USA and stored there. With Google Analytics 4, IP anonymization is enabled by default. Due to IP anonymization, your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area.
Legal basis and revocation
The legal basis for this data processing is your consent in accordance with Art. 6 (1) (a) GDPR. You can revoke your consent at any time with future effect by accessing the cookie settings via our consent manager.
Data transfer to the USA
Google also processes data in the United States. We would like to point out that Google is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the United States that is intended to ensure compliance with European data protection standards when data is processed in the United States.
Storage period
The data we send and link to cookies is automatically deleted after 14 months.
5. Newsletter and contact
Contact form
If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We will not pass on this data without your consent. The processing of this data is based on Art. 6 (1) lit. b GDPR (contract fulfillment/initiation) or Art. 6 (1) lit. f GDPR (legitimate interest in processing).
Newsletter & service provider (Brevo)
This website uses Brevo (formerly Sendinblue / Newsletter2Go) to send newsletters. The provider is Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany, or its parent company Brevo SAS, Paris.
The data you enter is stored on Brevo’s servers (usually located in Germany or the EU). With the help of Brevo, we can analyze our newsletter campaigns (opening rates, clicks). Data processing is based on your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time by unsubscribing from the newsletter.
Data processing agreement
We have concluded a data processing agreement (DPA) with Brevo that ensures compliance with the GDPR.
6. Customer account and orders
Customer Account
By opening a customer account, you consent to the storage of your inventory data (name, address, email address, bank details) and your user data (username, password). This data is used to identify you as a customer and to enable you to manage your data. Processing is based on your consent in accordance with Art. 6 (1) (a) GDPR.
Processing of data (customer and contract data)
We collect, process, and use personal data only to the extent necessary for the establishment, content, or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 (1) lit. b GDPR.
7. Career section (applications)
When you send us your application, we process your associated personal data (e.g., contact and communication data, application documents) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) and Article 6(1)(b) of the GDPR.
8. Your rights as a data subject
You have the right to obtain information free of charge at any time about your stored personal data, its origin and recipients, and the purpose of data processing, as well as the right to correct or delete this data. If you have given your consent to data processing, you can revoke this at any time for the future. You also have the right to request the restriction of processing and the right to lodge a complaint with the competent supervisory authority.
To exercise these rights, please contact our Data Protection Officer (datenschutz@e-kern.com).
